Bail Application
If you are under investigation by the Hong Kong Police or the Independent Commission Against Corruption and detained, or charged with a criminal offence in court, Mak Yiu Wah Law Firm can apply for bail on your behalf. The bail conditions include payment in cash or other means and other additional conditions, such as surrendering your passport and reporting to the police station regularly. For most defendants in criminal cases, being able to obtain a self-signed bond is like getting a chance to be reborn. They do not need to have a criminal record or go to court to defend themselves, which reduces a lot of mental stress. They can then correct their mistakes and start a new life.
Self-signed bond
Depending on the severity of each case, common offences for which a “self-signed bond” may be applied include:
- Theft, such as shoplifting
- Criminal Damage
- Common Assault
- Unlawful Fight in a Public Place
- Possession of a Dangerous Drug, but only a small amount of marijuana, etc.
According to the Department of Justice’s Prosecution Guidelines, the prosecution must consider the following factors when considering whether to agree to handle the case in a conduct-based manner:
- whether it is in the public interest to bring a prosecution;
- whether the consequences suffered by the offender are disproportionate to the severity of the crime;
- what penalties may apply if convicted;
- The offender’s age, criminal record, character, and mental state (at the time of the crime and at present);
- Victims’ opinions;
- The offender’s attitude toward the crime.
