Free legal lectures

Legal changes after the handover

Mr. Mak pointed out that the “one country, two systems” system advocated by Deng Xiaoping is very worthy of praise. The development of legal services in Hong Kong has not changed much after the return of Hong Kong to China. British law is still used under the “one country, two systems”. After the return of Hong Kong to China in 1997, the Court of Final Appeal was established as the highest court in the country. The legal provisions and cases made after the judgments are closely followed by the courts below the Court of Final Appeal, such as the Court of Appeal, the Magistrates’ Courts, the Civil Courts, etc.

Advantages of Hong Kong Law Reform of Mainland Law

The approachable lawyer said that the judgment of the Hong Kong Court of Final Appeal is like the British House of Councillors, where Hong Kong people decide the laws of Hong Kong. The Court of Final Appeal has a certain binding force, which is the valuable part of the common law. It is accumulated over a long period of time, and there are also different cases, views, and definitions for reference. If changes are needed, the Court of Final Appeal must make the final decision and reach a new conclusion.

Mr. Mak in short, the House of Councillors is the highest legal institution in the United Kingdom, with five Lord Chancellors overseeing all appeals courts in the United Kingdom. He said happily that although the laws in the Mainland are based on mainland law, the Mainland law firms have also begun to use the judgments of cases in various provinces across the country as references. For example, a law firm in Beijing has collected hundreds of thousands of cases electronically, which can be searched electronically and provided to lawyers to use judgments from other places to support their own arguments. Although it may not be like the common law in Hong Kong, it is already a good change. The legal provisions in the Mainland are based on the actual environment and standards, which is the advantage of absorbing the Hong Kong and British models.

The country’s “13th Five-Year Plan” has become a new highlight in the industry

Hong Kong can play the role of an intermediary for multinational companies to enter the Mainland, because both foreign and Mainland companies have confidence in Hong Kong’s legal services. Mr. Mak believes that Hong Kong is like a hybrid car, with both oil and electricity, and will still have great potential in the next 20 to 30 years. As far as he knows, Mainland barristers’ firms have already come to Hong Kong and formed joint ventures with overseas law firms to provide services for multinational financing. He firmly believes that the “Belt and Road” initiative can bring new highlights to the legal profession, allowing Hong Kong lawyers to increase international cooperation and achieve a win-win situation.

Hong Kong is a place where Chinese and Western cultures converge, where there are both cooperation and disputes. Hong Kong law, the common law, is trusted, and there are many years of cases to use. It will definitely become the best place to resolve disputes and arbitrate. He said that the Asian Arbitration Center is a battle between Singapore and Hong Kong. At the same time, he pointed out that as long as Hong Kong insists on its independent image, arbitrators have many choices, and they are better than Singapore in terms of quality, cost and efficiency. Hong Kong’s advantage also includes the support and trust of the country. When they choose the arbitration venue, they must choose Hong Kong as the best choice.

Promote the law from an early age

At the end of the interview, Mr. Mak  mentioned that legal knowledge should be added to the secondary school curriculum to impart legal knowledge to young people, so that they can understand legal rights, what is criminal and civil law, etc., to increase their interest. He strongly supports Hong Kong’s implementation of national education, and primary school students should know the country’s history from an early age. Patriotism is a must, not passive resistance and demonstration, but to actively face the difficulties and benefits of the country. Just like you should love your family, instead of running away from home when something happens, you should change it and turn it into a better place. This is the right way.
