Marriage Law

We welcome any inquiries about marriage-related legal issues, such as documents required for divorce, divorce application, documents required for cross-border marriage and special professional marriage, prenuptial agreement, scope of marriage validity, etc. Other inquiries are welcome, for example: if you get married overseas but have not yet registered in Hong Kong, will it still be valid as a marriage? Generally speaking, if an overseas marriage is conducted in accordance with local laws, its validity will be recognized by Hong Kong law, that is, it will still be valid as a marriage.

Nowadays, if you want to register your marriage or get married, you no longer need to go to the marriage registry to arrange for it. You are not restricted to getting married only at the marriage registry, or you will not be unable to get married because the marriage registry is full on that day. You only need to find a marriage lawyer to serve as the marriage celebrity. The marriage lawyer will arrange the marriage registration and marriage witness services to add style to your wedding.

Make an appointment with a lawyer within three months before the expected wedding date to discuss wedding details, provide identification documents and sign a proposed marriage notice. The required documents are identification documents of both parties. If the couple has been married before, they need to produce relevant documents of that marriage, such as: divorce decree, death certificate of former spouse or final decree of invalid marriage issued by the court… etc. If the couple has changed their name, they need to produce a deed of change of name/notarization of change of name. If the couple is under 21 years old, the parents or guardians are required to sign the Consent to Marriage Under 21 and the Declaration of Marriage Under 21 when signing the Notice of Intended Marriage, or apply for consent from a District Court Judge and produce the birth certificate of the applicant under 21 and the identity documents of the father, mother or legal guardian.

The lawyer will hand over the Notice of Intended Marriage to the Marriage Registrar, who will display the Notice of Intended Marriage at the Marriage Registry for at least 15 days. If no one objects, the Marriage Registrar can issue the Marriage Certificate at any time starting from the first working day after the 15-day display. When the marriage lawyer receives the Marriage Certificate, the marriage can be held.

The day before the wedding, the newlyweds need to check with a lawyer to ensure that there are no missing or incorrect information on the marriage certificate, and the newlyweds must arrange for two relatives or friends aged 18 or above to attend the wedding as witnesses.

On the wedding day, the newlyweds need to prepare their ID cards, marriage registration official certificate, wedding rings, etc., and the witness lawyer will explain the process before the registration ceremony begins, and the newlyweds will make a statement and sign in front of the witness lawyer; at the registration ceremony, the witness lawyer will read the oath and guide the newlyweds to read the marriage oath. After that, the newlyweds will sign the marriage certificate in the presence of the witness lawyer and witnesses. The lawyer will hand the marriage certificate to the newlyweds, and the marriage procedure is completed.

Marriage lawyer, Mr. Mak Yiu Wah, attends wedding ceremonies anywhere in Hong Kong and provides services of lawyer witnessing marriages and signing marriage registration certificates.
